The implementation of U.S. CBP Regulations

With effect from 13th August 2004, U.S. Customs and Border Protection (CBP) will begin the phased implementation of their requirement for advanced electronic presentation of data for all cargo shipments imported into the United States.

As a Carrier, we are responsible for the transmission of the accurate and complete cargo information, including the master air waybill (MAWB) and house air waybill (HAWB) data through the Air Automated Manifest System (AAMS) to the CBP no later than 4 hours prior to the arrival of the aircraft at the first port of entry in the United States. Therefore, EVA has the option for our customers to transmitting HAWB data directly to EVA or to the CBP, the details as below:

 

1. Direct transmission to the CBP:

If you are authorized to submit HAWB information to the CBP and you elect to transmit the HAWB information directly to the CBP, you will need to supply your Facilities Information and Resources Management System (FIRMS) code, in the Handling Information box of the MAWB, such as "HAWB data submitted directly to the CBP. FIRMS code XXXX"  accompanying the shipment.

2. Electronic transmission:

  • Electronically direct to EVA using FHL/2 message. The FHL messages must contain full shipper and consignee information as well as pieces, weight and detailed commodity description.

  • Electronically by way of FHL/2 messages via Cargo Community System (CCS) to EVA.

3. Manual input of HAWB data by EVA AIR:

If your good companies are unable to transmit the FHL/2 message, we will manually input the data into our AMS system. The accompanying documentation (7509 Form) must detail all of the HAWB data.

 

Regardless of whichever way is chosen to submit the HAWB information, it will be yourselves who will be liable for the accuracy of the documentation and transmitted information.

Below is further supplementary information that you need to be made aware of:

Master Air waybill Information:
Special attention should be paid to the description of goods used on the MAWB and HAWB. U.S. Customs have published a list of acceptable descriptions of goods on their website. General descriptions such as "pipes", "tools" and "apparel" are not acceptable.

House Air waybill Information:
Regardless of whether it is yourself who transmits data directly to CBP or EVA AIR by Cargo IMP messages, a consolidation manifest with full HAWB data must be supplied when consolidated shipments are tendered for carriage. The consolidation manifest shall include HAWB number, origin, destination, pieces, weight, acceptable description of goods and the name and address of the shipper and consignee. If this is not shown on the consolidation manifest, a hard copy of each HAWB should be supplied.

Shipper Loaded Units:
When you tender more than one shipper built ULD for carriage, the shipment must be accompanied by a consolidation manifest which provides an itemized listing of the pieces by HAWB and ULD number. We are required to report flight loading to HAWB and piece level and this information will allow us to fulfill the requirement in the event that ULD’s are transported as split shipments.

All documentation will be checked at the time of acceptance to ensure that we are able to comply with U.S. Customs requirements. Where documents are missing or found to contain inaccurate or insufficient information, which may result in non-compliance, there may be a delay incurred till we obtain the necessary information.

As the implementation of the new US customs regulations will generate costly measures, EVA AIR plans to share the cost with you. We will inform you the details when it is available.
